Richard L Zorek....10.24.06........Circuit Judge Joseph P. Dandurand, on Tuesday said state regulators overstepped their authority in May when they approved an Aquila Inc. power plant near Peculiar and reinstated his order to tear it down. Aquila will appeal. If Aquila is allowed to keep the $140 million facility it will set a very bad precedent. Companies could come in without proper authority and build, knowing they will eventually win the right in court. It's kind of like eminent domain with a twist.
